This Personal Data Privacy Policy (hereinafter - the Privacy Policy) is a contract between the online store, the site of which is located on the Internet at the address www.bigwines.com.ua, called the "Internet Store", and the user of the Internet store's services (hereinafter - "Buyer") and applies to all information received about the User by the Internet store "www.bigwines.com.ua" during the use of the Internet store website, which is located on the domain name bigwines.com.ua.

1. General provisions

1.1. The site administration does not control the authenticity of the personal data that the Buyer provides to the Internet store site.

1.2. This Privacy Policy applies exclusively to the website of the online store. The online store is not responsible for and does not control third-party sites to which the Buyer can go through links posted on the online store's website.

1.3. This Privacy Policy defines the order of interaction and conditions for the provision of services by the Online Store to the Buyer, based on his desire, desire and opportunity to use services for the purchase of Alcoholic Products on behalf of, on behalf of and at the expense of the Buyer, and their delivery, as well as on the desire of the Online Store provide the buyer with the information he needs, make a purchase and delivery on behalf of Alcoholic products.

1.4. The Buyer agrees to the terms of this Privacy Policy at the time of placing the Order by clicking on the "Place Order" button, which means the Buyer's confirmation that he has read this text and agrees to its terms. In the future, the Buyer's objection to giving his consent in this way relieves the Online Store from any responsibility for non-fulfillment of the terms of the contract and reserves the right for the Online Store to cancel the Order unilaterally.

1.5. The online store has the right, without prior notice to the Buyer, to engage third parties to perform the duties assigned to it in accordance with the Privacy Policy.

2 Definition of concepts and terms

2.1. "Website Administration of the Online Store" (hereinafter referred to as the "Website Administration") – employees authorized to manage the website, acting on behalf of LLC "BIG WINES," organizing and/or processing personal data, determining the purposes of processing, as well as the composition of personal data subject to processing, operations performed with personal data.

2.2. "Personal Data" – any information directly or indirectly related to a specific or identifiable individual (subject of personal data).

2.3. "Processing of Personal Data" – any operation or set of operations performed with personal data using automation tools or without them: collection, recording, systematization, accumulation, storage, refinement, extraction, transfer, use, dissemination, provision, access, depersonalization, blocking, deletion, destruction of personal data.

2.4. "Confidentiality of Personal Data" – the obligation of the Website Administration and others who have access to personal data to prevent their disclosure without the legal or mandatory consent of the subject of personal data.

2.5. "User of the Online Store website" (hereinafter referred to as the "Buyer") – a person who has access to the Website through the Internet.

2.6. "Cookies" – small pieces of data sent by a web server and stored on a user's computer, also transmitted by a web client or web browser to the web server in an HTTP request when opening a specific site page.

2.7. "IP Address" – a unique network address of a node in a computer network created based on the IP protocol.

2.8. "Online Store" – LLC "BIG WINES," established in accordance with the Legislation of Ukraine, operating the website located at www.bigwines.com.ua. Physical address – Kyiv, Igorivska Street, 1/8.

2.9. "Alcohol Products" – the assortment of products published on the Online Store website, obtained through alcohol fermentation of sugar-containing materials or made based on food products containing ethyl alcohol content of more than 1.2% by volume.

2.10. "Buyer" – an individual who has reached the age of eighteen, receiving information from the Online Store, placing orders, and instructing to purchase Alcohol Products presented on the Online Store website, for purposes unrelated to conducting entrepreneurial activities, or a legal entity / individual entrepreneur.

2.11. "Order" – a formal request placed by the Buyer and addressed to the Online Store for the purchase and delivery of Alcohol Products on their behalf and at their instruction.

2.12. "Website" – a collection of pages accessible through a web browser and software modules, integrated into a unified management system, located on the Internet at www.bigwines.com.ua.

3 Confidentiality and Protection of Personal Data

3.1. When registering on the Website, the Buyer provides personal data specified in section
4.2. of this agreement.

3.2. The Online Store receives the following data from the Buyer:

• Last name and first name;

• Company name (LLC, individual entrepreneur, etc.);

• Contact number;

• Email address;

• Password;

• Delivery address;

• Information about the Buyer's tastes and preferences;

3.3. By providing their personal data to the Website during registration or order placement, the Buyer consents to the processing and use (including transfer) of their personal data without limitation of the term of such consent in accordance with the Law of Ukraine "On Personal Data Protection" dated June 1, 2010.

3.4. The Online Store uses the received personal data for providing and promoting services offered by the Online Store, including through automated processing of personal data.

3.5. The Online Store guarantees non-disclosure of information received from the Buyer. Providing information by the Online Store to agents and third parties acting under a contract with the Online Store, including for fulfilling obligations to the Buyer, is not considered a violation, as well as in cases where disclosure of such information is required by law.

3.6. If the Buyer does not want the Online Store to continue processing their personal data, the Buyer needs to submit a request to the support service. In this case, the Buyer will not be able to continue using the services of the Online Store.

3.7. The Buyer is responsible for keeping their personal data up to date. The Online Store is not liable for inadequate performance or non-performance of its obligations due to the outdated or inaccurate information about the Buyer.

4 Information Messages

4.1. By registering on the Website or placing an order without registration, the Buyer agrees to receive informational messages from the Online Store and its partners acting under a contract with the Online Store, via SMS and email.

4.2. The Buyer has the right to opt out of receiving informational newsletters by adjusting the corresponding settings in the Personal Account.

5 Use of Materials Posted on the Website

5.1. The Website contains materials, trademarks, trade names, and other legally protected materials, including but not limited to texts, photographs, graphic images, music, and audio works.

5.2. All content on the Website is protected by Ukrainian law.

5.3. The Buyer is not allowed to use materials posted on the Website: make changes, publish, transmit to third parties, participate in sales or transfers, create derivative works, etc.

6 Other Conditions

6.1. This agreement is concluded within the territory of Ukraine and is governed by the laws of Ukraine.

6.2. The invalidity of any provision or part of this agreement does not invalidate the agreement as a whole.

6.3. Any disputes between the Buyer and the Online Store are resolved through negotiations. In case of failure to settle the dispute, the Buyer or the Online Store may refer the matter to judicial authorities in accordance with the applicable laws.

6.4. The Online Store has the right to amend the text of this agreement at its own discretion without prior notice to the Buyers.

7 Term of Agreement

7.1. The electronic agreement is deemed concluded from the moment the person who made the proposal to conclude such an agreement receives an acceptance of this proposal in the manner specified in Article 11.6 of the Law of Ukraine "On Electronic Commerce."

7.2. This agreement can be terminated by mutual agreement of the parties before the actual delivery of the goods by refunding the funds.

7.3. The parties have the right to terminate this agreement unilaterally in case of non-compliance with the terms of this Agreement by one of the parties and in cases provided for by the current legislation of Ukraine.
